A MAGISTRATE has told the Constitutional Court that the retention of retired judicial officers on contract is unconstitutional and discriminatory.
Benjamin Mwelwa, who is based in Livingstone, says allowing retired judicial officers to continue working on contract demotivates unretired and qualified staff who want to hold the positions held by those on contracts.
Magistrate Mwelwa contends that there are many magistrates already called to the Bar but have not been appointed as resident magistrates because the vacancies they are supposed to fill are occupied by retired officers.
