Ignore Bowman application

THE State has urged the Constitutional Court not to entertain Kabushi Member of Parliament Bowman Lusambo’s application to join proceedings in a case a Lusaka man wants the court to erase section 72 (a) of the Electoral Process Act. State advocate Kaumbi Ndulo-Mundia has opposed Mr Lusambo’s application to join the proceeding on grounds that the lawmaker has not demonstrated sufficient interest to be included as a party to the matter. Mrs Ndulo-Mundia said this is so because the piece of legislation under contention is an Act of Parliament and not a constitutional provision which he is at liberty to defend. This is in a case Lusaka resident Joseph Busenga has petitioned the Constitutional Court to erase section 72(2) of the Electoral Process Act citing Attorney General Mulilo Kabesha as the respondent.
