Cite HH, submits State

LUSAKA High Court judge Mwila Chitabo has reserved ruling on whether to declare United Party for National Development (UPND) president Hakainde Hichilema and his running mate Geoffrey Mwamba as vexatious litigants after an application by Attorney- General Likando Kalaluka.
Vexatious litigation is legal action which is brought regardless of its merits, solely to harass or subdue an adversary.
Mr Kalaluka submitted that Mr Hichilema and Mr Mwamba have been making habitual and repetitive applications before different courts and seeking similar reliefs with an obvious possibility of a result that would bring the courts in Zambia into ridicule.
This is an application for an order to deem Mr Hichilema and Mr Mwamba that the full effect of Section 16 of the High Court Act applies to them.
Mr Kalaluka submitted that the two petitioners have presented similar reliefs in different courts.READ MORE
