Woman, 27, sues for defamation of character

SYLVESTER CHISHIMBA, Lusaka
A 27-YEAR-OLD woman of Lusaka’s Lilanda township has denied being in a relationship with a married man she claims does not even know.
Margaret Jere was in the Matero Local Court in a case in which she sued Florence Nosiku, 31, for defamation of character.
Jere told senior Local Court magistrates Lewis Mumba and Pauline Newa that problems started in September this year when Nosiku went to her (Jere’s) home in the morning to confront her about the affair.
“Nosiku came to my home around 06:40 accusing me of having an affair with her husband. She said I should stay away from him. But I don’t know who her husband is. I am a vendor at one of the bars, so I meet a lot of customers,” she said.
She admitted that it is the nature of her business to chat with her customers because she sells chips, but that nothing goes beyond business.
“At times I do sit and chat with my customers when they are drinking, but nothing unusual happens. I am a happily married woman. But Nosiku came to my home already charged and started insulting me. She called me a prostitute trying to ruin her marriage. I don’t even know which of my regular customers she is accusing me of being my lover,” she said.
Nosiku admitted calling Jere a prostitute because she claimed she had spotted her (Jere) with her husband drinking beer on four occasions.
“I was tipped about the affair by neighbours. They had been seen drinking beer on four different occasions.
“I witnessed one occasion where he was giving her money, but when I confronted him, he denied the affair.
“I did want to take any chances with Jere after losing my first marriage to another woman and that is the reason I approached her,” she said.
Passing judgment, the court upheld the claim and advised the two parties to reconcile and live in harmony.
