State appeals Kambwili acquittal

JUSTINAH KAPAMBWE, Lusaka
THE State has appealed against Chishimba Kambwili’s acquittal in a matter he was facing 39 counts of being in possession of property suspected to be proceeds of crime and uttering a false document.
Kambwili, his son Mwamba, Mwamona Engineering and Technical Services and Zambia Revenue Employees (ZRA) Brano Musonda and Mulenga Kapilima were charged with one count of making a document without authority.
It is alleged that Mr Kambwili and Mwamona presented a false ZRA tax clearance certificate to Zesco Limited purporting that it was genuinely issued resulting in the award of a contract for the construction of houses and toilets under the Lunzua Hydro Power project.
But in a ruling delivered this month on September 9, Lusaka High Court judge Mwaka Mikalile, who sat as a principal resident magistrate, acquitted Kambwili and others as the prosecution failed to prove their allegations
