A FOURTY-THREE-YEAR -OLD man of SOS area is seeking to divorce his wife because she allegedly beats him with the help of her daughter every time they have a quarrel.
Edward Banda told a fully packed Matero local court that his wife always pulls his manhood while his step daughter squeezes his neck whenever the pair argues.
He also told the court that his wife beats him and denies him conjugal rights.
This is in a case in which Banda sued Francesca Phiri, 34, for divorce. Facts before the court were that the pair got married in 2003 and have no child together. Bride price was not paid.
Banda told the court that the pair has never enjoyed peace since in their marriege.
“My wife and step-daughter always beat me, she pulls my manhood while her daughter squeezes my neck. I am usually rescued by the neighbours,” he said.
In his submissions, Banda pleaded with the court to dissolve his fourteen-year marriage on grounds that he was scared of losing his life.
But Phiri denied Banda’s allegations and told the court that he does not like her two children.
She told the court that Banda has been proposing love to her daughter for some time now.
“Since we got married, he has been irresponsible and spends most of his time drinking beer. I found love messages from my husband on my daughter’s phone. She also revealed to me that he has been bothering her for some time now,” Phiri explained.
In her submissions, she told the court that she does not support the idea of the pair divorcing because she still loves her husband.
In passing judgement, magistrate Pauline Newa sitting with magistrate Miyanda Banda dismissed the claim for divorce on grounds that bride price was not paid.
