Rapist jailed 20 years

THE Kitwe High Court has imposed a 20-year jail sentence with hard labour on a 25-year-old man of St Anthony Township in Kitwe for rape.
High Court judge Isaac Kamwendo jailed Chama Mwila after upholding his conviction by the subordinate court.
Mwila was facing one count of rape and he admitted the charge when he appeared in the subordinate court.
Facts before the court are that on the fateful night between 19:00 hours and 23:00 hours, Mwila broke into an old woman’s house and raped her.
Mwila allegedly removed the blankets from the woman’s bed, undressed and raped her but alert neighbours came to her rescue and apprehended him.
In mitigation through legal aid counsel Mwendalubi Kapukutula, Mwila asked for leniency.
“The convict is a first offender and did not waste the court’s time as he readily admitted the charge,” Mr Kapukutula said.
But Mr Justice Kamwendo noted that although Mwila is a first offender who is entitled to the court’s leniency, the fact that he raped an old woman is an aggravating circumstance.
He sentenced Mwila to 20 years imprisonment with hard labour with effect from the day he was arrested.
Mr Justice Kamwendo granted Mwila leave to appeal to the Supreme Court if he is dissatisfied with the verdict.
