Pay K5,000 or 9 months prison

THE Livingstone Magistrate’s Court has sentenced a 29-year-old businessman who assaulted his brother-in-law to nine months imprisonment with

hard labour.
This is in a case in which Patrick Kapeta of house number DSV 142 in Dambwa Extension township is charged with assault.
On July 8 this year, Kapeta assaulted his brother-in-law, Christoper Sichongwe.
Before the assault, Kapeta picked a quarrel with his brother-in-law after asking why he was building on a piece of land belonging to his sister, Christine Kapeta.
The matter was later reported to Dambwa Police Post and investigations were instituted, which led to the arrest of Kapeta.
In mitigation, Kapeta asked the court to be lenient on him because he is the bread winner of the family.
Sentencing him, magistrate Liyungu Chikoko said it was the duty of her court to punish offenders so that they could reform.
She said the punishment would help would-be offenders to learn and be deterred.
“I hereby fine you K5,000 which you have to pay as compensation to your brother-in-law or in default if you fail to pay then you will serve nine months imprisonment with hard labour,” she said.
