Ndola man jailed 1 year for theft

NDOLA magistrate Misozi Banda has sentenced a 34-year-old man of Mushili township in Ndola to one year imprisonment with hard labour for stealing goods worth K4, 900 from Kasembo Transport Limited.
Delivering judgment on Tuesday, Ms Banda said the prosecution had proved the case of theft against Stanslous Mutale beyond reasonable doubt.
Ms Banda said although Mutale was remorseful for his actions the court had a duty to impose custodial sentence because such offences had become prevalent in Ndola.
““Having considered the evidence on record, I am satisfied that the items as listed on the charge sheet were stolen from Kasembo Transport Limited. In the circumstances, I have no doubt that the prosecution has proved all the ingredients of the offence namely theft and I so find the accused guilty as charged.
“I sentence you to one year imprisonment with hard labour, with effect from today (Tuesday),” Ms Banda said.
She granted Mutale leave to appeal to the High Court within 14 days.
In mitigation, Mutale pleaded with the court to consider imposing a non-custodial sentence on him because his children would suffer if he was sent to prison.
It was alleged that Mutale on June 4 this year in Ndola, stole two tent ratchets,  motor vehicle switch and a towing inch altogether worth K4,900,the property of Kasembo Transport Limited.
