Ndola car dealer swindles man out of K20,000, lands in jail

A MOTOR vehicle dealer of Masala township in Ndola has been sentenced to eight months imprisonment with hard labour for swindling a man out of K20,000 on the pretext that he had a motor vehicle for sale.
Moses Silungwe, 28, was facing one count of theft by agent.
Magistrate Mwansa Chibalo last Thursday convicted Silungwe after he pleaded guilty to the charge.
“I have followed the facts as presented before the court by the prosecution and I’m satisfied that they disclose the offence charged. Based on your own admission of the offence, I hereby find you guilty as charged and I accordingly convict you.
“I sentence you to eight months imprisonment with hard labour with effect from today [February 5],”Mr Chibalo said.
It was alleged that on unknown dates but between December 14, last year and January 24, this year in Ndola, Silungwe received K20, 000 cash from Mohammed Abdi to clear a motor vehicle on his behalf.
In mitigation, Silungwe asked the court to be lenient on him as he was a first offender and was married with two children.
Facts before court were that Silungwe obtained money from Abdi on the pretext that he was selling a motor vehicle but the car in question in fact was not cleared by the Zambia Revenue Authority (ZRA) at the border.
The court heard that when the accused was asked to deliver the motor vehicle to Abdi as promised, he failed to do so.
He was apprehended and taken to the police station and he denied having committed the offence, the facts read in brief.
