FORMER Zambia Red Cross Society secretary-general Charles Mushitu and two others have sued Attorney-General Likando Kalaluka demanding over K2 million in damages for malicious prosecution after they were acquitted of abuse of authority of office by the Lusaka Magistrates’ Court.
In this case, Mr Mushitu, former Zambia Red Cross Society finance and administration manager and Kelvin Chiposwa, a former board member of the Zambia Red Cross Society, are demanding K2,425,500.
The trio submitted that Mr Kalaluka, through the Drug Enforcement Commission (DEC), charged them with abuse of authority without probable cause.
They contend that there was malice and lack of reasonable cause to charge them with the said offence because the DEC knew that the trio had not abused their office.
The trio submitted that they were alleged to have destroyed documents belonging to the Zambia Red Cross Society when in fact the DEC had seized numerous documents from Mr Mushitu and two others, adding that they had also formally handed over their offices prior to leaving the Society.
