Man gets 5 years for assaulting neighbour’s kid

A SERENJE man, aged 36, has been sentenced to five years imprisonment by the Kabwe High Court for assaulting his neighbour’s child after the minor fought with his children.
Evans Mubanga, who appeared before Kabwe High Court judge-in-charge Dominic Sichinga for sentencing, beat the eight-year-old boy, occasioning him bodily harm.
Particulars of the case are that on October 27, last year, in Serenje, Mubanga did unlawfully assault a child and caused him bodily harm, contrary to the Laws of Zambia.
Mubanga was arrested on October 8, last year and charged with assault of a child.
Legal Aid Board senior counsel Kamo Simfukwe said Mubanga acted in the manner he did because the victim attacked his two children and destroyed his property.
Ms Simfukwe said his client deserved leniency because he regrets his actions and is a first offender.
“Mubanga is a breadwinner, with a wife and six children under his care,” she said.
Passing judgment, Mr Justice Sichinga pointed out that the subject offence carries a maximum sentence of 10 years and five years minimum.
“I consider your mitigation as you are a first offender. I will exercise my leniency on you and I will sentence you to five years imprisonment,” he said.
