Man fined for deserting wife

NOMSA NKANA, Lusaka
THE Matero Local Court has slapped a man with a fine of K15,000 after he deserted his HIV positive wife who he said demanded the use of condoms to avoid re-infection.
This was heard in the Matero local Court before Justice Lewis Mumba and Pauline Newa in a case where Sapphira Banda, 41, of Matero Township dragged Joseph Mumba, 47, of Makeni to court for divorce.
Banda said when she was expecting her sixth child, Mumba became promiscuous and often verbally abused her.
“He told me he wanted a woman with big buttocks,” she said sending the gallery laughing.
She said Mumba began to neglect her and their children after he found a lover whom he also later dumped for another woman.
Banda said when she asked him why he left her, he said, “you want me to use a condom when my lover does not ask me to use one.”
But after having marital problems with his current wife, he returned to Banda seeking reconciliation.
“He told me he wanted to kill his current wife so that we could get back together, shocked, I discouraged him. He then told me he would return but to date, he has never done that,” she lamented.
And in his statement, Mumba said the reason he left Banda is because she opened a bar in Mandevu which was making her get home around midnight or the wee hours of the morning.
Mumba said he ended up beating her which resulted in Banda going to live with her sister.
“When I followed her there, her sister told me to stay away from Banda. My wife also warned me that the man who pays her rent would deal with me if I kept pursuing her,” he said.
The following day, Mumba said he met Banda with a man who was introduced to him as her husband.
“With that, I gave up on her as she told me she was married,” he said amid sneers from the gallery.
