Man, 35 pleads not guilty to theft

A 35-YEAR-OLD man of Katozi village in Nakonde district has pleaded not guilty to stealing K18,000.
This is in a case in which Steven Nyirenda is facing one count of theft by agent.
Particulars of the offence are that Nyirenda, on unknown dates but between June and September this year in Kitwe, jointly and whilst acting together with others unknown stole K18, 000 cash entrusted to him by Abraham Daka who wanted the accused to help him clear his Toyota Brevis with the Zambia Revenue Authority (ZRA).
And Nyirenda, through his lawyer Douglas Mazumba, urged the court to grant him bail pending trial.
Mr Mazumba submitted that Nyirenda is of fixed abode and the offence he is facing is bailable.
He added that Nyirenda had been in custody for the past 10 days and was willing to abide by the conditions that the court will set for him.
But the state, through prosecutor Juma Banda, objected to the application on grounds that Nyirenda is a flight risk.
“Although the offence is bailable, the accused is facing various offences and he has already appeared before other courts. In fact, police are yet to charge him for another offence and they were actually here to pick him up,” Mr Banda said.
He added that the state was afraid that if granted bail, Nyirenda, who is a Nakonde resident, was likely to go for good and that it would be very difficult for him to be traced if he crossed into Tanzania.
But Mr Mazumba said it was not in order for the state to start referring to cases that are not before court.
Mr Musonda reserved his ruling to this Friday.
