A JUDGE has dismissed a case Minister of Justice Given Lubinda wanted the High Court to compel the Lusaka City Council to implement its 2016 resolution to confer on him the status of alderman.
Lusaka High Court judge Pixie Yangailo threw out Mr Lubinda’s lawsuit on grounds that he unjustifiably delayed to file the application for judicial review to challenge the council’s delay to confer the alderman status on him.
“As a consequence of my finding, I refuse to grant leave to apply for judicial review and accordingly dismiss the application,” Judge Yangailo said in a ruling delivered on Wednesday.
Mr Lubinda, who is also Kabwata Member of Parliament (MP), had sued the council seeking an order to compel it to implement its 2016 resolution to bestow on him the status of alderman.
An alderman is a member of a municipal assembly or council.
