Kenyan fined for illegal stay

KASOLE SAKAVUYI, Ndola
THE Ndola Magistrate’s Court has imposed a K1,000 fine on a 37-year-old Kenyan man, in default three months simple imprisonment, for illegally staying in Zambia.
Magistrate Ben Akende on Wednesday jailed Heikel Yusuf Warsame of Ndeke township in Ndola after he pleaded guilty to unlawful stay in Zambia.
“You willfully stayed in Zambia without authority and I find you guilty on your own admission,” Mr Akende said.
Warsame on June 20 this year, entered Zambia through the Nakonde border and overstayed after the expiry of his 30-day permit.
Facts before the court are that on the fateful day, immigration officers on routine patrol in Ndola apprehended Warsame and took him to Ndola immigration regional office for interviews.
The court heard that immigration officers discovered that Warsame was illegally staying in Zambia.
Warsame was charged and arrested for unlawful stay in Zambia.
In mitigation, Warsame begged for forgiveness and submitted he did not intend to commit the offence.
He submitted that he overstayed because he was looking after his brother who is resident in Zambia after he was involved in a road traffic accident.
