Incest accused walks free

A 33-YEAR-OLD man of Kitwe’s Natwange East accused of having sex with his biological daughter has walked to freedom after being discharged by the Kitwe Magistrate’s Court.
In this a case, Rockie Lesho was facing one count of incest.
It is alleged that Lesho, on April 1, last year in Kitwe, had unlawful carnal knowledge of his biological daughter.
Lesho has been appearing in court for nearly 10 months but trial has not started because the State is awaiting instructions from the Director of Public Prosecutions (DPP).
When the matter came up again last Friday, magistrate Leonard Tembo discharged Lesho in accordance with section 88 (a) of the Criminal Procedure Code (CPC).
“Note that this is not an acquittal. The State can re-arrest you on the same facts once they receive instructions but for now you are free to go home,” Mr Tembo said.
