Convicted Kitwe woman appeals case

A KITWE mother convicted of causing grievous bodily harm on her biological child has appealed to the High Court to quash the subordinate court’s decision on grounds that it misdirected itself by proceeding to hear her case when it did not fall under the lower court’s jurisdiction.

This is in a case in which Melanie Kaonga was convicted of one count of causing grievous bodily harm with intent to maim, disfigure, or disable, contrary to section 224 of the Penal Code, Cap 87, of the laws of Zambia.
Legal Aid counsel Mwendalubi Kapukutula representing Kaonga told Kitwe High Court Judge Chilombo Phiri when the appeal came up yesterday that the trial court erred in law and fact by proceeding to hear the subject matter when it did not have the jurisdiction to do so.
