4 minors dragged to court for defiling girl, 9

CHAMBO NG’UNI, Kabwe
FOUR minors aged between seven and 12 years old in Kabwe have been dragged to court for allegedly defiling a fellow minor aged nine.
The minors, aged seven, nine, 10 and 12, were expected to take plea yesterday before Kabwe magistrate Chimuka Mutafela.
When the matter was called, public prosecutor Fortune Kalima, however, informed the court that the minors and their sureties were not around.
Mr Mutafela adjourned the matter to today for plea.
The children, two of them aged seven and 12 from the same family, are facing one count of defiling a child contrary to Section 138 of the Penal Code Chapter 87 as amended by Act Number 15 of 2005 and Act Number 2 of 201 of the Laws of Zambia.
The minors, on January 12 this year, jointly and whilst acting together, allegedly had unlawful carnal knowledge of another minor.
And before the same court, a woman of Chibombo testified how her brother-in-law allegedly defiled her eight-year-old younger sister.
The witness told the court that her brother-in-law Rodrick Musongo allegedly defiled her sister on January 1 this year after he returned from the tavern.
She said on the fateful night, Musongo was sleeping with the victim and three other children in the sitting room of her two-room house and around 03:36 hours, she heard her cry.
The witness narrated that when she peeped through the door of her bedroom, she only saw the accused covering himself with a blanket.
She said around 06:00 hours on January 2, she noticed that the girl had been crying and when she enquired, the girl was mute, then she started crying.
The witness said after the girl returned into the house, Musongo, who was seated outside the house, looked troubled and he told her that he would rather die than be arrested.
She said after four days, she discovered a torn pant of the girl and when she asked, she revealed that it was her uncle who tore it before he defied her.
The witness said when she examined her genitals, she found them swollen and when examined further at Liteta Hospital, it was also confirmed that she had been defiled and the police arrested Musongo.
