Kitwe man sues over murder accusation

A 27-YEAR-OLD man of Kitwe has narrated before the Buchi Local Court how his neighbour accused him of murdering her father who was found dead at Mutende Primary School in Kitwe.
This was heard before senior Local Court magistrate Vincent Sundwapo in a case in which Anthony Musakanya sued Evelyn Miti for defamation of character.
Musakanya told the court that on the material day, he was at home when Miti hurled insults at him and accused him of murdering her father who was working as a security guard at Mutende Primary School in Kwacha Township.
Musakanya’s mother told the court that on July 2 this year, she witnessed an incident where Miti accused Musakanya of murdering the deceased.
“Miti manhandled my son while accusing him of murdering her father,” she said.
And Miti told the court that on the material day, she was called by the head teacher at Mutende Primary School, where her father was found dead and that he informed her that two men who were found at the school were arrested.
“I went to the school with my cousin. As we returned home, we discussed how my father’s killer will be brought to book. Musakanya overheard our conversation and concluded that we were saying he was the one who killed my father,” she said.
The court could not make a ruling as the case was still under investigation. Further, the court said Musakanya and his mother were related, meaning there was a high possibility that the mother could not testify against her son.
