THE Livingstone Magistrate’s Court has committed a 19-year-old boy to the Livingstone High Court after finding him guilty of defiling a 13-year-old girl of Kazungula district.
This is in a case in which Nicholas Muzamani of Kazungula is charged with defilement.
It is alleged that on June 21 this year in Kazungula, Muzamani had unlawful carnal knowledge of a girl under the age of 16 years.
Facts before the court are that, the accused person proposed love to the victim and stated that he wanted to have a sexual relationship with her but she turned down the proposal.
The accused persisted with his proposal for the two to have a relationship and that in May this year she consented to the relationship and they had sex.
In June this year, the two had sex and the mother to the girl discovered that something had gone wrong with her daughter, whom she later confronted.
The mother reported the matter to the police and the accused was later charged and arrested for the subject offence.
And in admitting the facts, the accused person told the court that he had proposed love to the girl who turned down the proposal but continued going to his place.
“I have only had sex with her twice and it was consensual sex. She kept on coming to my house every day, I was surprised that I was arrested after explaining all this to the police,†he said.
In his judgment, Livingstone Magistrate Asden Shanduba said he would convict the accused person after his own admission of the charge but however committed the matter to the High Court for sentencing.
“We are told that you are a first offender in this offence that you have been convicted for. The sentence requires the blessings of the high court, so I will send you to the High Court,†he said.
